Why? This panel will discuss the present state of the law
regarding the preservation of corporate net operating
losses (NOLs) in bankruptcy proceedings, including a
discussion of when NOLs can be preserved, why
disputes arise over the preservation of NOLs and
mechanically how NOLs may be preserved in plans of
reorganization. Also discussed will be the impact of
NOL preservation on state tax issues given the varying
