Employers want to do more with less and emails and Internet tools are the preferred method of communicating with employees in most companies. So-called benefit Exchanges, both public and private, promoting one-stop shopping and investment activity with lots of options via the Internet from anywhere and at any time, is continuing to be embraced by the business world. In addition, internet access and communications regarding 401(k) accounts are expected by most participants. Outside and inside counsel are being asked to advise the client on a plethora of government-required communications in the pension and health and welfare plan arena, including explaining the IRS, DOL, SEC, HHS and PBGC rules on electronic disclosures and privacy.
