Employers want to do more with less and emails and Internet tools are the preferred method of communicating with employees in most companies. So-called benefit Exchanges, both public and private, promoting one-stop shopping and investment activity with lots of options via the Internet from anywhere and at any time, is continuing to be embraced by the business world. In addition, internet access and communications regarding 401(k) accounts are expected by most participants. Outside and inside counsel are being asked to advise the client on a plethora of government-required communications in the pension and health and welfare plan arena, including explaining the IRS, DOL, SEC, HHS and PBGC rules on electronic disclosures and privacy. This program will take a hard look at these often-overlapping rules. The speakers will discuss ways both outside and inside counsel can assist the employer in streamlining communications to employees in a cost-effective, compliant and "green friendly" fashion. Join our speakers on a timely topic that focuses on:

  • The do’s and don’ts of benefits disclosures
  • Tips on Keeping the technical practical and the practical legal
  • Comparison of pension disclaimer issues versus welfare benefit plan disclosures
  • Pitfalls to avoid
  • Litigation activity

This is the third of a four part series on the Affordable Care Act. The first program was entitled, The ACA Roadmap: Shared Responsibility Requirements and the second one was entitled, The Roadmap to Compliant Wellness Programs. The fourth program on The Roadmap to State and Private Exchanges will be held in the fall. CDs and Podcasts of the first two programs can be ordered by clicking on the links above.
