Two recent federal laws impose immediate compliance obligations on sponsors of group health plans. The American Recovery and Reinvestment Act includes new COBRA premium assistance subsidies for the unemployed, and the Children’s Health Insurance Plan Reauthorization Act (CHIPRA) includes new special enrollment and notice provisions. The new provisions take effect quickly, and plan sponsors (including multi-employer health plans and for-profit, tax-exempt, church and governmental employers) will need to take immediate steps to comply. Some of the topics we’ll address include:
- Who is eligible for COBRA premium assistance?
- How do multiemployer health plans get the subsidy?
- How do plan sponsors receive the federal subsidy?
- What are the new COBRA notice and special election period requirements?
- What are the new CHIPRA special enrollment and notice obligations?
- What are the new HIPAA privacy changes?
